What Do You Need to Open a Restaurant?

1. Business License

Step one: a business license. This is required to open and operate any business in the United States.

This license legitimizes new businesses as legal entities. Depending on the specific location of your new restaurant, you may be required to pay a percentage of your total sales or a flat yearly fee. 

If your restaurant sells alcohol, you will need to obtain a federal business license and a state business license. If not, you may just have to obtain a state business license.

Simply search for your state + business license on Google and follow the application procedures as laid out on your state government’s site. And don’t forget: usually, you will need to renew your license annually or pay by a certain deadline.

2. Employer Identification Number (EIN)

Like a business license, all businesses must also obtain an employee identification number in order to operate in the U.S. An EIN is assigned by the IRS and it is really just a tax ID number. Prepare to sit on this one for a while – the IRS only issues one EIN per day.

3. Certificate of Occupancy

4. Food Service License

Food service licenses are generally issued by the city or county health department. The health department will make an in-person visit to your establishment to ensure that you are following all restaurant food safety regulations. Once this license is obtained, the health department will continue to make regular visits to inspect your restaurant. 

And make sure to keep up to inspection standards: if you fail an inspection at any point, you could risk being stripped of your food service license.

You can obtain a food vendor’s license application from your local health department, either online or in person. You can apply for a temporary, fixed, or mobile food service license. When applying, you’ll need the name of your restaurant, an address for a permanent kitchen facility (even for food trucks), and the owner’s personal information. 5. Sign Permit

If you rent or lease the building, it is also a good idea to get written approval from your landlord in addition to the official sign permit.

6. Music License

Music is essential to a restaurant experience: adding to the ambiance, mood, and individual aesthetic. To play music in your restaurant, you’ll need a music license to avoid copyright infringement. This includes live music, as well as music from a CD, or streaming service.

The fines for playing copyrighted music without a license can range from $750 to $30,000.

10. Seller’s Permit

A seller’s permit allows a state to identify a business as a collector of sales tax. If you’re a restaurant in California, this is a permit you should research. Some states may call this permit a “sales tax” permit or license. Most businesses, especially in the food and beverage industry, need to obtain a seller’s permit as well as the resale certificate.

To apply, you will need to present the state with a detailed plan of the proposed pick-up/drop-off area that shows the number of spaces required as well as a letter of agreement between your chosen valet operator and the restaurant stating financial agreements including how and when a guest pays for the service.

13. Dumpster Placement Permit

Not often considered, but often needed, the dumpster placement permit allows your restaurant to situate a state dumpster outside your kitchen, where chefs can dispose of food waste. 

The stipulations and cost of the dumpster placement permit depend on the size of the dumpster, the exact placement of it, and the restaurant location.

14. Live Entertainment License

Live events are a great way to bring in new guests to your restaurant. 

If you plan to host live events in your restaurant or bar, then you will need to apply for a live entertainment license.

The licensing authority in your state approves annual entertainment licenses where food or drink is served on the location’s premises. This can apply to a concert, dance, exhibition, cabaret, or public show conducted on your restaurant premises.

15. Pool Table License

Some states and counties require restaurants and bars to apply for a pool table license in order to offer a pool table to customers. The applicant will be considered based on location (is there a high amount of pedestrian traffic or parking traffic) and can limit the hours of operation of the pool table and the number of pool tables allowed.

Licenses and Permits Across the USA

As you’ve certainly learned throughout this article, licenses and permits for restaurants vary across state lines. According to the U.S. Small Business Administration, the state, county, or city you live in determines your license requirements and fees: “States tend to regulate a broader range of activities than the federal government.” These activities include restaurants and food service establishments.

Business owners need to research their own state, county, and city regulations, as these all vary depending on your restaurant’s location. Generally, visiting your state’s website can help you find out which permits and licenses you need.

Also, be sure to keep your license current. According to the SBA, “Some licenses and permits expire after a set period of time. Keep close track of when you need to renew them — it’s often easier to renew than it is to apply for a new one.”

Here are a few tips for getting restaurant licenses and permits in Florida, Massachusetts, California and New York — please note that these sections show a few examples of state-specific requirements, and are not exhaustive lists of everything you might need.

Getting Restaurant Licenses and Permits in Florida

Getting a restaurant license in Florida, according to the Florida Department of Business and Professional Regulation (DBPR), means first choosing between a seating license and a non-seating license. 

According to the Florida DBPR, “A Seating license is a type of food service license for a permanent structure that includes seats for customers to eat or ‘dine in’. This is the most common food service license and is typically what people think of when someone refers to a restaurant. In addition to dining in, a Seating license covers take-out/delivery and catering services.”

The steps to acquiring a restaurant license in Florida include:

  • Creating a DBPR Online account

  • Applying for and completing a plan review (which is required “if an operator constructs or uses a space that has never been licensed by the division, has been closed for more than one year, or has been remodeled. In general the plan review process ensures food service facilities meet sanitation and safety standards.”)

  • Applying for a license and paying the license fee

  • Scheduling and passing the licensing inspection

Getting Restaurant Licenses and Permits in Massachusetts

The State of Massachusetts Department of Public Health lays out requirements for food establishments on its website. If you’re running a restaurant in the city of Boston, Massachusetts, you must apply for a food permit and get an inspection before serving food to the public. According to the City of Boston,

  • First, determine whether your restaurant is already open or currently under construction. 

  • If your restaurant is a new build, start the process to get a food service permit by having the city review your plans.

  • If your restaurant is already built but hasn’t opened yet, apply for the permit and get an inspection.

  • You’ll need to pay a fee, which varies depending on the type of food operation you’re running.

Furthermore, the state passed the Massachusetts Food Establishment Regulation in 2001, which requires that all food service businesses meet health and safety codes, which include appointing a “Person in Charge” who must be 18 or older, and get certified as a food manager.

Getting Restaurant Licenses and Permits in California

When opening a restaurant in California, check the California Business Portal. You’ll need a business license, first of all, and can contact your city or county to learn more. 

Additionally, you’ll need a health permit, “as a business serving food or beverages for human consumption,” usually obtained from your county environmental health department, according to the California Business Portal.

You’ll also need to abide by the California Retail Food Code and The California Health and Safety Code, which establishes “requirements for food safety including the hygiene, cleaning and sanitizing of equipment and utensils, food storage, and janitorial facilities.”

Furthermore, “at least one employee must be certified in food safety by passing an approved Food Safety Certification examination, and all other employees involved in the preparation, storage, or service of food in a food facility must obtain a Food Handler Card.”

Getting Restaurant Licenses and Permits in New York 

When thinking about opening a restaurant in New York, the biggest differentiator to start with is whether the restaurant will be located inside or outside of New York City. According to the New York State Department of Health, Restaurant permits “are issued by the local health department responsible for the area where the food service establishment is located.”
